There was a motion to accept the minutes of the September 17th, 2009 meeting.  The motion was seconded and accepted with a vote of 5-0-0.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.  

Mr. Alfieri informed the Commission members that the Town Engineer is proposing a catch basin in the new cul de sac off Populatic Street to collect and send the stormwater back to the catch basin.  Mr. Alfieri requested that this be done as a field change correction to the plan.  

There was a motion to ratify the Town Engineer’s recommendation as a field modification.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.    

Extension Permit:  438 West Central Street – SE159-862
Mr. Alan Micale, a representative of Ayoub Engineering, appeared before the Commission to request an Extension Permit to the Orders of Conditions for this site.  He informed the Commission members that this site is the Shell Gas Station on West Central Street.

Mr. Alfieri informed the Commission that this Extension Permit would be under the Local Bylaw only and recommended that the Commission grant the applicant a one-year Extension under the Local Bylaw.

There was a motion to extend the Orders of Conditions for 438 West Central Street for one year under the Local Bylaw.  The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent - 7 Old Forge Hill Rd. – Unionville Commercial - CE159-988
The Commission Chairman opened the public hearing and stated that a letter has been received from the applicant’s representative dated October 15th, 2009 requesting a continuance of the public hearing until the October 29th meeting.

There was a motion to continue the hearing for 7 Old Forge Hill Road until October 29th.  The motion was seconded and accepted with a vote of 5-0-0.

GENERAL BUSINESS

Minor Buffer Zone Activity:  22 Spruce Pond Road
The applicant has requested to replace the existing deck and dig about 4 ft. down for placement of the sono tubes to building code regulations and also the addition of 1 sono tube footing for this deck.  The wetlands are located approximately 35 ft. from the proposed work.

There was a motion to issue a Negative Determination with the 3 standard conditions and 1 additional condition that any excess dirt must be removed from the site.

The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue a Negative Determination with the 3 standard conditions and 1 additional condition that any excess dirt must be removed from the site.

The motion was seconded and accepted with a vote of 5-0-0.
        
        Discussion:  DelCarte Registration Dams 3&5
There was a discussion among the Commission members regarding the registration of Dams 3&5 at the DelCarte property.  A Commission member who has been primarily working on this issue suggested that the Commission first review the General Comments for Dam 3 and then go onto Dam 5.

A Commission member asked what is the pending urgency of this issue.
He was given an overview stating that the first phase reports are for the inspection of the dams and the documents are for review before the Commission at tonight’s meeting.

The condition, upkeep and further inspections of Dams 3&5 were the topic of discussion and these matters need to be addressed before these dams may be registered with the State.

Mr. Alfieri provided the Commission with a brief overview of the status of these dams regarding the requirements for registration.

The Commission members ensued with a discussion and comments regarding the draft documents received from the Pare Corporation, the consultant hired to conduct the study of these dams.  The question is should they be repaired or removed and which dams will come down or not.
The matter of comments and corrections to the documents by the Commission members were suggested by Mr. Alfieri.

There was a consensus among Commission members that comments and suggestions should be compiled into one document and taken up for discussion at a future meeting.  This would then be forwarded to the Pare Corporation.

Mr. Alfieri will convert these documents into Word documents and forward them to the Commission members for comments and edits before merging them into one document.  Comments would be needed for discussion at the next Conservation meeting.

Commission Comments
A Commission member informed the remainder of the Commission that he would like to take up the matter of the harvesting of trees in the Town Forest again.  

It was previously suggested that some of the trees could be cut in order to improve the vitality of the Town Forest as well as some additional benefits for the forest as well.  He would like to take up this project again.

Mr. Alfieri will contact Mr. Phil Benjamin, the Forester who has previously performed a project in the Town Forest, to determine what his recommendations are to continue the project for this season.  

Mr. Alfieri informed the Commission that they should consider having the Forest Stewardship Plan updated as it expires next year.  The Commission will discuss this matter at the next Conservation meeting.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 5-0-0.  The meeting adjourned at 8:15 p.m.
